AMERICAN EXPRESS WINS AGAIN

The United States Supreme Court has denied the Florida Accountancy Board's petition for certiorari in the matter of Stephen M. Miller, CPA, and American Express. The board sought to overturn a decision of the Court of Appeals that holding out as a CPA while performing tax and accounting services for American Express Tax and Business Services (TBS) was permitted under free speech as per the first amendment to the U.S. Constitution. The Court of Appeals' decision also sent the case back to the lower court to reconsider TBS standing and position in the
lawsuit.

The decision gives added momentum to TBS as it pursues the acquisition of accounting and tax practices in other jurisdictions. *
